In agreeing to these terms and conditions, you have not relied on any representation other than those expressly stated in these terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this Agreement.
WEBSITE USER AGREEMENT
I. ACCEPTANCE OF TERMS
Welcome to the Cascade Lakes Resident Website. The following are the current terms of the Website User Agreement which may be updated by the Board of Directors from time to time at a duly‑noticed Board meeting.
II. MEMBER ACCOUNT, PASSWORD, AND SECURITY
The User is solely responsible for maintaining the confidentiality of the User’s password and account and is fully responsible for all activities that occur under the account. If there is a breach of security, immediately notify the Cascade Lakes webmasters of any unauthorized use.
III. MEMBER CONDUCT
A. Personal attacks are not permitted. That includes posts that threaten, make fun of, incite, or attack others. These posts will be removed. Posts must be civil with no foul language or links to offensive sites. Any post that is unacceptable will be deleted by the webmasters and shall be referred to the Board of Directors for review. An email will be sent by the webmasters to any member whose post is deleted.
B. Any posted copyrighted materials will be deleted. If the User copies and pastes copyrighted material, it will be deleted.
C. Logos or banners are not allowed in any posts or signatures and will be deleted by the webmasters.
D. Do not post commercial advertising messages or solicitations or any political statements. Any URL containing a referral code or referral address will be edited or deleted at the discretion of the webmasters. These are considered advertising. Listing of any URL in a signature is limited to only “home pages” that include no advertising or referral. Links to businesses or pages with advertising are prohibited in signatures. No “blind or hidden” referral links are allowed.
E. The residents of Cascade Lakes, by and through their contracting authority, and pursuant to the provisions of Titles 39 and 47 of the United States Code, hereby place the reader and the User of this website on legal notice that the resident information contained herein may not be disclosed, disseminated, or used in any manner whatsoever. This includes but is not limited to purposes of solicitation of products or services by mail, telephone, or otherwise, without the express, advance written permission of the individual resident.
F. Any conduct by the User that restricts or inhibits the use of this site by any other User will not be tolerated. The Association reserves the right to pursue all legal and equitable remedies against the User.
G. Any material in any post that is disruptive, argumentative, or not suitable for this forum may be edited or deleted at the discretion of the webmasters. The notice will be sent to the address displayed in the member’s Resident Profile. The Resident Profile email address is a member’s responsibility. If an entire thread is deleted only the member who posted the original message will be notified.
H. Any violations of these terms and conditions shall be reported to the webmasters using the “Contact Us” feature on the website.
IV. USER RESPONSIBILITIES
The User agrees to not use the website to:
A. Transmit any content that is unlawful, harmful, disruptive, argumentative, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially or ethnically not suitable.
B. Transmit any content that the User does not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships, or under nondisclosure agreements).
C. Transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
D. Transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.
E. Intentionally or unintentionally violate any applicable local, state, and/or national law(s).
F. “Stalk” or otherwise harass another.
G. Collect, store, or use personal data about other Cascade Lakes residents.
V. VIOLATIONS
A. The webmasters are responsible to remove posts that violate these terms, notify the User that the post was removed, and refer the issue to the entire Board of Directors for review by copy of the notification. The notification to the User will include reason(s) why the post was removed and a notice that the issue has been referred to the Board.
B. If this is a first alleged violation, the Board will be notified to determine whether a violation has occurred, at a duly-noticed Board meeting. No action taken will be taken at that time other than a notice to the User with a copy to the Webmasters of the boards decision and a right to a Grievance hearing. The notice will also state that additional violations will result is a suspension from use of the message board.
C. If it is a second violation or more, the Board President will convene a duly‑noticed Board meeting to determine whether to suspend the User who made the post in question. The Board may call a special meeting with 48‑hour notice if the User continues to post. Any additional violating posts made by the User before suspension/penalty is applied will be removed and the violation penalties outlined below will be increased accordingly.
D. If the Board votes to discipline the User by a violation notice or suspension, the User has fourteen (14) days to request a review by the Grievance Committee. During this time, the post will remain unposted. If the User does not make an appeal to Grievance, the Board’s decision is final, and the suspension begins at the end of the 14‑day period. The Board will notify the User and the webmasters of its decision as well as a notice of the time the suspension is to begin.
E. The Grievance Committee shall report its decision to the Board, the webmasters, and the User. The determination of the Grievance Committee is final. If the Grievance Committee affirms a Board vote of violation or suspension, then the penalty and/or suspension begins on the date that the Grievance Committee gave written notice of its decision. If the Grievance Committee reverses the Board’s determination, there is no penalty and/or suspension.
F. Violations of these terms within the last two years will result in the following:
1. On the first occurrence, a notice will be sent to the User by the webmaster.
2. On the second occurrence, the posting User will be removed from the Message Board for 30 calendar days.
3. On the third occurrence, the penalty will be a 6-month Suspension.
4. On the fourth occurrence, the User will be removed from the Message Board for two years.
5. There will be a 2-year statute of limitation, after which time the User’s suspension will be reset to zero.
VI. INDEMNITY
The User agrees to indemnify and hold the Cascade Lakes Residents’ Association, and its committee volunteers, officers, agents, or other partners, and employees, harmless from any claim or demand. This includes reasonable attorneys’ fees, made by any third party due to or arising out of the content the User submits, posts to, or transmits through the website, use of the website, violation of these terms, or violation of any rights of another.
VII. TERMINATION
A. The User agrees that the Cascade Lakes Residents’ Association Board of Directors at a duly‑noticed Board meeting may terminate the User’s account (or any part thereof) or use of the website and remove and discard any content within the website. The User agrees that the Cascade Lakes Residents’ Association or those acting on its behalf shall not be liable to the User or any third party for termination of access to the website, for good cause.
B. If termination or suspension is implemented under this section, the User has the right to a hearing before the Grievance Committee if requested within 14 days of written notice of termination. Termination shall not be implemented during the period of the Grievance process. The decision of the Grievance Committee is final.
C. The Cascade Lakes Residents’ Association Board of Directors may discontinue providing the website, or any part thereof, with notice at a duly‑noticed Board meeting.
VIII. DEALINGS WITH ADVERTISERS
The User’s correspondence or business dealings with, or participation in promotions of, advertisers found on or through the service, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between the User and such advertiser. The User agrees that the Cascade Lakes Residents’ Association or those acting on its behalf shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the website.
IX. LINKS
The Cascade Lakes website may provide links to another website. Cascade Lakes Residents’ Association has no control over such sites and resources. The User agrees the Cascade Lakes Residents’ Association or those acting on its behalf are not responsible for the availability of such external sites or resources and do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. The User acknowledges and agrees that the Cascade Lakes Residents’ Association shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such site or resource.
X. DISCLAIMER OF WARRANTIES
By logging on to the Cascade Lakes website the User understands and agrees that use of the website is at the User’s sole risk. The service is provided on an “as is” and “as available” basis. Cascade Lakes disclaims all warranties of any kind, whether express or implied.
XI. NOTICE
Notices to Users may be made via email or regular mail. The website may also provide notices of changes to these terms after Board vote at a duly‑noticed Board meeting by displaying notices, or links to notices, on the website.
The Cascade Lakes Residents’ Association, the Cascade Lakes Board of Directors, and those acting on its behalf are not liable for the content of any posts.
XII. INVALIDITY OF A PARAGRAPH
If any section, sentence, or paragraph of terms are found to be invalid, void, or unenforceable, the remainder of the terms will continue in force.
